1What this agreement is
This End User Licence Agreement (this licence) governs your licence to use the OSCE World software and content. It is between you and MedMatrix Pty Ltd (ABN 37 701 007 061), trading as OSCE World (we, us, our).
This licence covers the software: what you may do with it, what you may not do with it, and what rights you have in our content.
It does not cover the commercial relationship. Plans, prices, currency, tax, payment, refunds, plan limits, account suspension and your consumer rights all live in our Terms of Service, and are not repeated here. Nothing in this licence varies them.
If anything in this licence is inconsistent with the Terms of Service, the Terms of Service prevail.
By creating an account, signing in, or otherwise using OSCE World, you agree to this licence, to the Terms of Service, to the Privacy Policy and to the Usage Policy. If you do not agree, do not use OSCE World.
2Definitions
Application means the OSCE World software, including the web application at osceworld.com/app and any mobile or downloadable application we release.
Content means the clinical stations, case scenarios, sample dialogues, marking schemes, examiner rubrics, explanatory notes, audio prompts, text, graphics and other material we make available through the Application. It does not include Your Content.
Your Content means what you put into the Application, including your messages during a station, your written post-station presentation, any audio you speak where voice input is enabled, and feedback you send us.
Platform means the Application and the Content together.
3Licence grant
Subject to your compliance with this licence and with the Terms of Service, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Platform for:
- your own education, training and examination preparation; or
- where you hold a facilitator or administrator role, teaching and assessing your own students.
This licence lasts while your account is open and you are complying with these documents. Every other right is reserved.
You may download or print your own reports for your personal study and portfolio.
4Restrictions
You must not, and must not permit anyone else to:
- copy, reproduce, republish, download (other than ordinary browser caching and your own reports), screen-record, scrape or redistribute any Content;
- share your account credentials, or resell, rent, sublicense or provide access to the Platform to any other person;
- use automated means (bots, scrapers, crawlers, scripts) to extract Content or Platform data;
- use the Content, or any output generated by the Platform, to train, fine-tune, evaluate or benchmark any artificial intelligence or machine learning system;
- reverse engineer, decompile, disassemble or attempt to derive the source code, system prompts, model instructions or marking logic of the Platform, except to the extent the law expressly permits you to and you have first asked us for the information you need;
- circumvent rate limits, daily limits, plan expiry or access controls;
- remove or obscure any copyright, trade mark or proprietary notice.
Our Usage Policy sets out these and other rules in full, and explains what happens if you break them.
5Our intellectual property
The Platform is protected by intellectual property law and belongs to us. That includes the Application's software, design, branding and documentation, and it includes our case library and marking sheets: the selection and arrangement of the stations, the structure and scoring criteria of the marking schemes, and the specifications we write them to.
As section 7 explains, individual simulated patient replies, scores and written feedback are generated at the point of use. We do not claim ownership of any particular generated sentence.
Nothing in this licence transfers any intellectual property right to you, except the limited licence in section 3.
We are not affiliated with, endorsed by, or accredited by any medical school, royal college, examining board or registration authority. Where we name an examination format or a body (including the Australian Medical Council, the Royal Australian College of General Practitioners, the Australasian College for Emergency Medicine and the General Medical Council), we do so only to describe what our stations are modelled on. Those names and marks belong to their respective owners.
6Your content
You keep ownership of Your Content. You grant us the licence described in section 9 of the Terms of Service, which is limited to what is needed to run the Platform for you, show your results to your facilitator where your account is connected to an institution, keep the service secure, and meet a legal obligation.
You confirm that you have the rights necessary to grant that licence and that Your Content does not infringe anyone else's rights.
Do not enter real patient information into a station. Section 5 of the Usage Policy explains why this matters more here than the phrasing of an ordinary acceptable-use clause suggests.
7AI-generated content
Simulated patient replies, scores, marking breakdowns and written feedback are generated in real time by artificial intelligence models. No clinician reviews them before they are shown to you. Results are probabilistic: the same station can produce different responses and different marks on different attempts.
The Platform is a training tool, not an official assessment. Marking is a guide only and is deliberately strict. The AI can miss a point you actually made. Section 4 of the Terms of Service explains this in full, and it is the section of the whole pack most worth reading before you take a score to heart.
The Platform does not provide medical, clinical, legal or professional advice, and must never be used to make or inform a decision about the care of a real person. All patients, characters, names, voices, case histories and scenarios are entirely fictional, created for educational and examination-practice purposes. They are not based on and do not depict any real patient, clinical case or medical record. Any resemblance to any actual person, living or deceased, is coincidental and unintended.
8Voice features
Voice input is optional and off unless you turn it on. When it is on, audio from your microphone is streamed to our speech provider, converted to text, and the text is saved in your station transcript and handled like anything else you type.
We do not retain your raw audio after transcription. We instruct our speech provider not to use your audio to improve its models.
By using voice features you confirm that you are participating voluntarily, and that you are not recording any other identifiable person without their consent.
The Privacy Policy sets out in full what happens to voice data, including how the free tier differs, and how to ask for access, correction or deletion.
9Updates, changes and availability
We may update the Application, add or remove features, and change or retire Content as the product develops. Where an update materially reduces core functionality you have paid for, section 11 of the Terms of Service explains what we will do about it.
Where you have installed a mobile application, updates may be delivered automatically through the relevant app store. This licence applies to updates unless an update comes with its own terms.
10Term and termination
This licence starts when you first accept it and continues while your account is open.
It ends automatically if your account is closed or your access is terminated. You may end it at any time by closing your account.
Section 14 of the Terms of Service and section 10 of the Usage Policy govern suspension and termination, including notice, the chance to fix a problem, the review path, and what happens to money you have paid.
On termination you must stop using the Platform and delete any copies of the Content in your possession, other than your own reports.
Sections 4, 5, 6, 7, 11, 12, 13 and 14 of this licence survive termination.
11Warranties and your consumer rights
Nothing in this licence takes away your consumer rights.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in this licence excludes, restricts or modifies any right or remedy you have under that law, or under any other law that cannot be excluded by agreement.
Subject to that, and to any express promise we make in the Terms of Service, the Platform is provided as it is. We do not warrant that the Content is complete, accurate, current or error-free, that the Application will be uninterrupted, or that using it will improve your result in any assessment.
Section 16 of the Terms of Service sets out your Australian Consumer Law rights in full. Section 17 covers mandatory consumer protections if you are outside Australia.
12Liability
Our liability to you is governed by section 18 of the Terms of Service, which is subject in every case to your non-excludable rights. It is not restated here, and nothing in this licence limits our liability further than that section does.
13Export controls and sanctions
You confirm that you are not located in a country subject to a government embargo that applies to us or to the app store you obtained the Application from, and that you are not on any applicable list of prohibited or restricted parties.
14Governing law
This licence is governed by the law of New South Wales, Australia, and each party submits to the non-exclusive jurisdiction of the courts of that State and the courts that hear appeals from them.
If you are a consumer living elsewhere, this does not deprive you of the protection of the mandatory laws of the place you live, or of your right to bring proceedings there where the law gives you that right.
15Changes to this licence, and contact
We may update this licence as the Application changes or the law requires. The version and date at the top show when it last changed. Section 20 of the Terms of Service describes the notice we give for a material change that disadvantages you, and applies equally here.

16Acceptance
You accept this licence by ticking the acceptance box at sign-up and continuing, or by otherwise accessing or using the Platform. Doing so is your electronic signature and binding acceptance.
We keep a record of when your account accepted this licence and which version it accepted.
Schedule 1Additional terms for mobile applications
This Schedule does not apply yet. OSCE World is currently a web application. This Schedule applies only if and when you obtain OSCE World as a downloadable application from an app store, and only to that application. Until then it has no effect.
AIf you obtained OSCE World from the Apple App Store
The following terms apply in addition to the rest of this licence. Where this Schedule conflicts with the rest of this licence, this Schedule prevails for the Apple App Store version.
A1. This licence is with us, not Apple. This licence is concluded between you and MedMatrix Pty Ltd only, and not with Apple Inc. We, not Apple, are solely responsible for OSCE World and its content.
A2. Scope of licence. Your licence to use OSCE World is a non-transferable licence to use it on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that it may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
A3. Maintenance and support. We are solely responsible for providing any maintenance and support for OSCE World, as specified in this licence or as required by applicable law. Apple has no obligation to furnish any maintenance and support services.
A4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If OSCE World fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for OSCE World. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to OSCE World, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our sole responsibility.
A5. Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to OSCE World or your possession and use of it, including product liability claims, any claim that OSCE World fails to conform to an applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
A6. Intellectual property rights. If a third party claims that OSCE World or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
A7. Legal compliance. You represent and warrant that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.

A9. Third party terms. You must comply with any applicable third party terms of agreement when using OSCE World.
A10. Third party beneficiary. Apple and Apple's subsidiaries are third party beneficiaries of this licence, and on your acceptance of this licence Apple has the right, and is deemed to have accepted the right, to enforce this licence against you as a third party beneficiary of it.
BIf you obtained OSCE World from Google Play
This licence is between you and MedMatrix Pty Ltd only, and not with Google. We, not Google, are solely responsible for OSCE World and its content, and for providing any maintenance and support.
Your use of OSCE World is also subject to the Google Play Terms of Service. Where those terms give you rights that this licence does not, those terms apply.
CPurchases made inside a mobile application
Where a purchase is made inside a mobile application, the app store's own billing and refund arrangements may apply to that purchase in addition to, or instead of, section 13 of the Terms of Service. We will say clearly at the point of purchase which applies.
